Terms of Service

The terms that govern your access to and use of Chocho Journal, our iMessage-first health journalling service. Please read them carefully.

About us and these terms

Chocho Journal ("Chocho", "we", "us", "our") is a service operated by Oriono Digital Limited, a company registered in England and Wales with company number 14864124, whose registered office is at 186a Cowley Road, Oxford, OX4 4UE. "Chocho Journal" is a trading name of Oriono Digital Limited.

These Terms of Service (the "Terms") govern your access to and use of Chocho, including our website, your dashboard, and the iMessage journalling service. Our Privacy Policy and any onboarding information we give you form part of these Terms.

By creating an account, subscribing, or using Chocho, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use Chocho.

You can contact us at any time. For general and support enquiries, email hello@chochojournal.com. For legal notices, email legal@chochojournal.com.

We may update these Terms from time to time. Section 18 explains how changes work.

Definitions

In these Terms:

  • Account means the account you create through our sign-in provider to access your dashboard.
  • Content means the messages, symptom scores, notes, and other information you send to or record with Chocho.
  • Dashboard means the web area where you can view your journal history, analytics, reports, and exports.
  • Payment Provider means DodoPayments, our merchant of record, described in section 7.
  • Service means the Chocho Journal service in all its parts, including the website, the Dashboard, and the iMessage journalling experience.
  • Subscription means a paid plan for the Service, whether monthly, yearly, or lifetime.

Eligibility

Chocho is for adults only. You must be at least 18 years old and able to enter into a legally binding contract to use the Service.

By using Chocho you confirm that you are 18 or over. If we learn that a user is under 18, we may suspend or close the Account and delete the associated data.

You are responsible for making sure that your use of Chocho is lawful in the country where you live and use it.

What Chocho is, and an important health notice

Chocho is a digital health journal. You text Chocho about your health in natural language, and it organises those messages into a structured journal, symptom scores, a daily Chocho Score, summaries, analytics, and doctor-friendly reports and exports.

Please read this notice carefully. It affects your legal rights and your safety.

  • Chocho does not claim, nor aim, to replace your healthcare provider or your doctor.
  • Chocho gives no medical advice whatsoever. It is simply a digital journal.
  • We do not claim to fix, improve, cure, treat, diagnose, prevent, or manage any condition or symptom, and we do not give advice of any kind.
  • Chocho simply helps you keep a clear record of your own health journey, so that you can see how you might manage your condition better and prepare useful information to discuss with your own doctor.
  • Chocho is not a medical device and is not intended to be used as one. It is not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your doctor or another qualified health professional with any questions about a medical condition, medication, or treatment. Never disregard professional medical advice, or delay seeking it, because of anything you have read or recorded in Chocho.

Chocho is not for emergencies. Chocho does not monitor your messages in real time and cannot respond to urgent or emergency situations. If you are experiencing a medical emergency, or think you might be, contact your local emergency services immediately. In the United Kingdom this is 999, or NHS 111 for urgent but non-emergency help. In the United States this is 911. Elsewhere, use your local emergency number.

Any decisions you make about your health remain yours and your healthcare provider's. You rely on the Service at your own discretion and are responsible for your own health decisions.

How the Service works

Chocho works through Apple iMessage. After you subscribe, you complete a short onboarding in your Dashboard, and we prepare a number for you. This usually takes a few hours and normally no longer than 24 hours. We will notify you by email when it is ready. You then save Chocho as a contact and begin texting.

Chocho is available only through iMessage. We do not currently support SMS, RCS, Android, or other messaging platforms.

The Service depends on Apple iMessage, which we do not own or control. We are not affiliated with, endorsed by, or sponsored by Apple Inc. If iMessage is unavailable, changed, or restricted, this may affect or interrupt the Service, and this is outside our reasonable control.

The only automated emails you receive as part of the Service are a provisioning notification when your number is ready, an account confirmation email when you sign up, and a purchase confirmation and invoice when you pay. These are sent through our providers. We do not currently send marketing email.

Useful analytics take a few days of consistent logging to appear. The quality of your journal, scores, and reports depends on what and how often you choose to log.

Your Account

We provide sign-in and account management through a third-party identity provider. You are responsible for keeping your sign-in details secure and for all activity that happens under your Account.

You must give accurate account information and keep it up to date. You must tell us promptly if you believe your Account has been accessed without your permission, by contacting hello@chochojournal.com.

You may not share your Account, and you may not let anyone else use the Service through your Account or your provisioned number.

Plans, pricing, and payment

Chocho is offered on monthly, yearly, and lifetime plans. Monthly and yearly plans begin with a 7-day free trial. The current plans and prices are shown on our website and at checkout.

Free trials. When you begin a monthly or yearly plan, you provide a payment method but are not charged the subscription price for the first seven days. Unless you cancel before the trial ends, the Payment Provider will automatically charge the price shown at checkout and your selected billing cycle will begin. You can cancel from your Dashboard before the trial ends to prevent the first subscription charge. Lifetime plans are charged at checkout and do not include a free trial.

Merchant of record. Payments are processed by DodoPayments, which acts as the merchant of record and reseller for your purchase. This means that when you buy a Subscription, your payment contract for that transaction is with DodoPayments, and DodoPayments is responsible for billing you, issuing invoices, and handling applicable sales taxes, VAT, or equivalent charges. Your use of the Service itself remains governed by these Terms with us. DodoPayments' own terms and privacy notice also apply to the payment.

Prices may be shown in different currencies, and the currency, taxes, and final amount payable are those displayed at checkout. You are responsible for any taxes that are not collected by the Payment Provider and that apply to you.

"Lifetime" plans. A lifetime plan gives you access for the lifetime of the Chocho Journal service. It does not mean your own lifetime, and it does not mean the Service will continue forever. If we permanently discontinue the Service, a lifetime plan will end at that point. A lifetime plan is a one-off payment with no recurring fee, and includes access to updates to the Service while it operates.

We may change our prices from time to time. Any price change will apply to new purchases and to renewals that fall due after the change. It will never change the price of a Subscription period you have already paid for, and where the law gives you a right to cancel because of a price change, you keep that right.

Renewals

After the 7-day free trial, monthly and yearly Subscriptions begin and renew automatically at the end of each billing period, at the plan and price then in effect, unless you cancel before the relevant charge or renewal date. Lifetime plans do not renew.

We will make the renewal terms clear to you before you buy, and the renewal date is available to you. You can cancel at any time as described in section 9, so that your Subscription does not renew.

Cancellation, cooling-off, and money-back guarantee

Cancel at any time. You can cancel a recurring Subscription at any time from your Dashboard. When you cancel, your Subscription continues until the end of the period you have already paid for, and then does not renew. Section 15 explains what happens to your data afterwards.

Your statutory cancellation right. If you are a consumer, you normally have a legal right to cancel a purchase of digital content and services within 14 days of buying it under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Because Chocho begins to provide the Service to you promptly after purchase, by agreeing to these Terms and completing your purchase you expressly request and consent to the Service starting immediately, and you acknowledge that once the Service has begun you lose your statutory 14-day right to cancel the digital content. For the service elements, if you cancel within the 14-day period after supply has begun with your consent, you may be charged for what you have used up to that point. This does not affect our 30-day money-back guarantee below, which is more generous than your statutory cooling-off right.

Our 30-day money-back guarantee. Separately from and in addition to your statutory rights, we offer a 30-day money-back guarantee on all plans, including lifetime. If you are not happy within 30 days of your purchase, contact hello@chochojournal.com and we will refund you, with no questions asked. This guarantee can be used once per customer. Refunds are processed through the Payment Provider using your original payment method.

Nothing here removes your legal rights. These cancellation and refund arrangements are in addition to your statutory rights as a consumer, which we cannot exclude or limit. If you are a consumer in a country outside England and Wales, you keep any mandatory consumer protections that apply where you live.

Your Content

You keep ownership of your Content. Your journal is yours.

To operate the Service for you, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, and display your Content, and to create the scores, summaries, analytics, reports, and exports that make up the Service. This licence exists only so that we can provide the Service to you, and it ends when your Content is deleted, except where we must keep limited records to meet a legal obligation.

We do not sell your Content, and we do not use it to serve advertising. To organise your messages into a journal, they are processed by third-party LLM providers. Our Privacy Policy explains in detail how we handle your Content and personal data, including the providers we rely on.

You are responsible for your Content. You must not record anyone else's personal information in Chocho without a proper basis for doing so.

Acceptable use and fair use

You agree to use Chocho only for your own personal health journalling, and lawfully.

You must not:

  • use the Service in any way that breaks the law or infringes anyone's rights;
  • attempt to gain unauthorised access to the Service, other accounts, or our systems;
  • interfere with, disrupt, or place an unreasonable load on the Service;
  • use any script, bot, or automated method to interact with Chocho, or send messages at a rate or volume that is not consistent with normal human use, for example messaging the Service many times per second;
  • copy, resell, or make the Service available to third parties; or
  • misuse the Service to harass, harm, or impersonate others.

Normal, everyday human use is not capped. The fair-use limits in this section exist only to prevent abuse and to protect the Service for everyone. If your use is abusive or automated, we may rate-limit, suspend, or close your Account as described in section 15.

Intellectual property

We, or our licensors, own all intellectual property rights in the Service, including the website, the Dashboard, the Chocho Score, the software, and our branding. Nothing in these Terms transfers any of those rights to you.

We grant you a limited, personal, non-transferable, non-exclusive right to use the Service for your own personal use while your Subscription is active and in line with these Terms.

"Chocho", "Chocho Journal", and our logos are our trading names and marks. You may not use them without our written permission.

Availability, changes, and the nature of the Service

Chocho is provided by an early-stage, fast-moving company, and the Service is developing quickly. We add, change, and remove features as we improve it. This means the Service may change over time, and occasional downtime, interruptions, delays, or faults can happen, despite our efforts to test carefully and to keep the Service running.

We do not promise that the Service will always be available, uninterrupted, or error-free. We will make reasonable efforts to keep it available and to fix problems promptly.

We may suspend the Service temporarily for maintenance, updates, or reasons outside our control, and we will try to give notice where we reasonably can.

We may discontinue the Service or any part of it. If we permanently discontinue the whole Service, we will give reasonable notice where we can, and section 9 and any applicable consumer law will govern refunds.

Third-party services

The Service relies on third-party providers to function, including providers of accounts and sign-in, payments, hosting and storage, iMessage delivery, the model that helps organise journals, website analytics, and in-product support and feedback tools. These providers are described in our Privacy Policy.

We are not responsible for third-party services that we do not control, including Apple iMessage. Their own terms may apply to your use of them.

Cookies. Our website uses cookies and similar technologies, including essential cookies needed to sign you in and optional analytics cookies that we use only with your consent. Our Privacy Policy explains what we use and how you can control it.

Suspension, termination, and what happens to your data

You can stop using Chocho and cancel your Subscription at any time from your Dashboard.

We may suspend or end your access to the Service, on notice where reasonable, if you seriously or repeatedly break these Terms, if your use is abusive, unlawful, or automated, or if we are required to do so by law.

After your Subscription ends, whether because you cancelled, it lapsed, or it was ended, your iMessage access to Chocho stops, but you keep access to your Dashboard for 90 days, so that you can review, export, and download your journal history, analytics, reports, and exports.

After that 90-day period, your data is deleted automatically. If you would like your data deleted sooner, contact hello@chochojournal.com and we will arrange it. We may keep limited records where the law requires us to, as explained in our Privacy Policy.

Your statutory rights and our disclaimers

If you are a consumer, you have legal rights under the Consumer Rights Act 2015 and other consumer protection law, including that digital content and services must be as described, fit for purpose, and of satisfactory quality, and that you have remedies if they are not. Nothing in these Terms excludes or limits those statutory rights. If anything in these Terms conflicts with your statutory rights, your statutory rights prevail.

Beyond those rights that cannot be excluded, and given the nature of Chocho as a journal described in section 4, the Service is provided on an "as is" and "as available" basis. In particular, we do not warrant that the Service will meet any medical, clinical, or diagnostic purpose, because it is not intended for any such purpose.

The scores, summaries, analytics, and reports Chocho produces are generated from what you log and are for your own reference and reflection only. They are not clinical assessments and should not be treated as such.

Limitation of liability

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited under the law that applies to you, including your statutory rights as a consumer.

Subject to the paragraph above, and because Chocho is a journal and not a source of medical advice, we are not liable for any decision you make, or do not make, about your health, treatment, or medication; any reliance you place on the scores, summaries, analytics, or reports, which are for reference only; or any loss or damage that was not reasonably foreseeable, or that arises from your failure to seek appropriate medical care.

Subject to the same paragraph, if we are found liable to you for any matter connected with the Service, our total liability to you is limited to the amount you paid us for the Subscription in the 12 months before the event giving rise to the liability.

We are not responsible for loss or damage caused by events outside our reasonable control, including failures or changes to Apple iMessage or to other third-party providers.

Changes to these Terms

We may change these Terms from time to time, for example to reflect changes to the Service, to our providers, or to the law.

If we make a significant change, we will give you reasonable notice, for example by email or through the Dashboard, before it takes effect. Your continued use of the Service after a change takes effect means you accept the updated Terms. If you do not accept a change, you may cancel as described in section 9.

We will always show the "last updated" date at the top of these Terms.

Data protection

We handle personal data in line with our Privacy Policy and applicable data protection law, including the UK General Data Protection Regulation and the Data Protection Act 2018. Please read the Privacy Policy to understand how we collect, use, share, and protect your data, and what rights you have.

Governing law, jurisdiction, and complaints

These Terms and any dispute connected with them are governed by the law of England and Wales.

The courts of England and Wales have jurisdiction over any dispute. If you are a consumer living in another part of the United Kingdom, or in another country, you keep the benefit of any mandatory consumer protections and, where the law gives you the right, you may bring proceedings in your local courts.

If you have a complaint, please contact us first at hello@chochojournal.com so that we can try to resolve it. We aim to respond promptly and to put things right.

General

  • Assignment. You may not transfer your rights or obligations under these Terms without our consent. We may transfer ours to another company, for example if our business is reorganised or sold, provided this does not reduce your rights.
  • Whole agreement. These Terms, together with the Privacy Policy and any information given to you at checkout and onboarding, are the whole agreement between you and us about the Service.
  • Severance. If any part of these Terms is found to be invalid or unenforceable, the rest continues to apply.
  • Waiver. If we do not enforce a right under these Terms straight away, that does not mean we give it up.
  • Third parties. No one other than you and us has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
  • Notices. We may contact you by email or through the Dashboard. You can send us formal legal notices at legal@chochojournal.com.
